Rider/Team Release, Indemnity and Cancellation Policy.

In consideration of the acceptance of this entry in the Lunatic Fringe Mountain Bike race competition promoted by Dirt Cycling Promotions (DCP.,) and/or its agent:

1. I hereby agree to comply with all the rules and regulations and event instructions of, DCP, and their directors.

2. For myself, my executors, administrators, heirs, next of kin, successors and assigns. I hereby

a) waive and release all claims I/and my team riders may have against Emu Creek extreme off road park, DCP, their officers, directors, events committee, volunteers, employees, agents and sponsors, the State of New South Wales , the local shire council or any one or more of them or their executors, administrators, heirs, next of kin, successors and assigns ("the release") including any and all claims for damages caused by the negligence of any of the above arising out of my participation in the event or its related activities, together with any costs including attorneys fees that may be incurred as a result of any such claim whether valid or not, and

b) indemnify and hold harmless the releases and each of them against any such claim that I or my guests or any one or more of the executors, administrators, heirs, next of kin, successors and assigns may have or assert any costs including attorneys fees with respect thereof.

3. I hereby acknowledge that I have sole responsibility for my personal possessions and sporting equipment during the competition and its related activities.I accept responsibility for the condition and adequacy of my competition equipment. I will compete wearing a helmet which satisfies the requirements of the Releasees Ride/Racing Rules or Regulations and that can protect against serious head injury, and assume all responsibility and liability for the selection of such a helmet. I have no physical or medical condition which to my knowledge, would endanger myself or others if I participate in this event, or would interfere with my ability to participate in this event.

4. I hereby acknowledge that participation in the competition carries with it potential hazard. I therefore release the promoter DCP, landowner, the officers, directors, events committees, members, volunteers, employees, sponsors, of any liability resulting from injury or death during the event or its related activities.

5. I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident and or illness during the competition.

6. This release should be construed as a risk warning and is given as a risk warning in accordance with the provisions of the Civil Liability Amendment (Personal Responsibility) Act 2002. Mountain biking is a dangerous recreational activity that involves a significant risk of physical harm.

7. I hereby agree that in the event of race cancellation due to storm, rain, inclement weather, wind or any other unforeseeable conditions, including personal injury or injury bike damage, my entry will not be refunded. I agree to submit a urine sample for drug Agency (ASDA) if required.

8. I hereby agree that by signing this on behalf of myself and my Team, I and my Team riders are responsible for my/their own personal accident and ambulance cover and expenses.Riders are responsible for their own Insurance/medical coverage.

9.By signing this entry form and release my personal details will be added to the Dirt/Depeche Cycling Promotions Summer of cycling email and postal mailing list. Dirt/Depeche Cycling Promotions will keep all mailing list information private and not share with any other parties.

10. I have read and understand this Release, Indemnity and Cancellation Policy and as Team manager on behalf of myself and my Team agree to abide by all the above conditions.

Depeche Cycling Promotions reserves the right to refuse entrys to any of our events from anyone for any reason.

CONSENT AND RELEASE OF PARENT OR GUARDIAN

I am the parent or guardian of

(Child). My Child is fit for the ride/race, and I consent to my Child's participation. I HAVE READ AND I UNDERSTAND THE ENTRY FORM AND RELEASE AGREEMENT. In consideration of allowing my Child to participate, I consent to it and agree that ITS TERMS SHALL LIKEWISE BIND ME, MY CHILD, my heirs, legal representatives, and assignees. I HEREBY RELEASE AND SHALL DEFEND, INDEMNIFY AND HOLD HARMLESS THE RELEASEES FROM EVERY CLAIM AND ANY LIABILITY that I or my Child may allege against the Releasees (including reasonable attorney's fees or costs) as a direct or indirect result of injury to me or my Child because of my Child's participation in the event, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES or others. I PROMISE NOT TO SUE RELEASEES on my behalf or on behalf of my Child regarding any claim arising from my Child's participation in the ride/race.
